Pharmily Limited is a company duly incorporated under the laws of the Republic of Kenya. We are fully licensed and regulated by the Pharmacy and Poisons Board (PPB) and operate in strict compliance with all applicable laws, regulations, and professional standards governing pharmaceutical practice, consumer protection, data protection, and e-commerce in Kenya.

Our services include, but are not limited to:

  • Dispensing of prescription-only medicines upon verification
  • Sale of over-the-counter (OTC) medicines
  • Sale of medical devices, wellness products, supplements, and health-related products
  • Telepharmacy and pharmacist-led medication review services

All services provided by Pharmily are offered strictly within the Republic of Kenya.

Intellectual Property Rights

2. Acceptance of Terms & User Eligibility

Reliance on Pharmily’s Services as a substitute for emergency medical care is expressly disclaimed.

4. Use of the Website and Acceptable Conduct

You agree to use our website and services responsibly and only for lawful purposes. You must not:

Pharmily reserves the right to suspend, restrict, or permanently terminate access to the website where regulatory concerns are identified, risk to patient safety or violation of these Terms.

5. Prescription Medications & Pharmacist Verification

5.1 Prescription Requirement

Certain medicines may only be supplied upon presentation of a valid prescription issued by a licensed healthcare professional authorized to practice in Kenya.

5.2 Prescription Submission and Review

Prescriptions may be submitted electronically through secure systems and are subject to mandatory review and verification by a licensed pharmacist.

5.3 Prescription Authenticity Declaration

By submitting a prescription, you confirm and warrant that the prescription is valid, authentic, issued by a licensed healthcare professional, issued to you or your legal dependent, and has not been altered, reused unlawfully, or submitted fraudulently.

5.4 Right to Refuse Dispensing

Pharmily reserves the right to decline dispensing where:

  • A prescription is expired, unclear, incomplete or illegal.
  • Suspected fraudulent activity such as submitting multiple prescriptions.
  • Dispensing would contravene legal or professional obligations
  • Clinical or patient safety concerns are identified

5.5 Controlled Substances

Pharmily does not dispense narcotic or controlled substances through online channels.

6. Telepharmacy and Remote Pharmacist Consent

By using our services, you acknowledge and consent to pharmacist consultations and prescription reviews being conducted remotely through secure electronic systems.

While telepharmacy improves convenience and access to care, it does not replace the need for in-person medical consultations when clinically necessary.

7. Therapeutic Substitution & Generic Medicines

Unless a prescriber has expressly indicated “no substitution,” Pharmily may, where clinically appropriate and lawful, dispense:

  • A generic equivalent
  • A therapeutically equivalent alternative
  • An alternative brand or pack size

Such substitution is undertaken in accordance with PPB guidelines and professional standards to ensure continuity of care, affordability, and availability.

8. Medication Risks, Side Effects and Adverse Drug Reactions

All medicines carry inherent risks, including potential side effects and adverse drug reactions (ADRs). By purchasing or using any medicine supplied by Pharmily, you acknowledge and agree that:

  • Individual responses to medicines vary
  • Side effects, interactions, or adverse reactions may occur
  • Medicines must be used strictly as directed
  • Pharmily not liable where used contrary to directions

Pharmily shall not be liable for harm arising from adverse reactions, misuse or drugs, overdose, non-compliance, undisclosed medical conditions, improper combination of drugs and drug-food or drug-drug interactions, or failure to follow professional pharmacist advice.

8.1 Consumer Health Claims Limitation

Pharmily does not guarantee therapeutic outcomes or effectiveness of any medication or health product, as results may vary between individuals.

8.2 Pharmacovigilance Responsibility

You agree to promptly report any suspected ADRs or unexpected side effects to Pharmily for onward reporting to the Pharmacy and Poisons Board in compliance with statutory pharmacovigilance obligations.

8.3 Evidence Retention and Audit Rights

Pharmily may retain transaction records, prescriptions, and communications in accordance with regulatory and legal requirements.

9. Product Information, Recalls, and Safety Notices

While reasonable efforts are made to ensure accuracy, Pharmily does not warrant that product descriptions, pricing, or availability are error-free. Product images, packaging, and visual representations displayed on the Site are for illustrative purposes only. Actual products supplied may differ in appearance, packaging, labeling, color, or branding due to manufacturer updates, regulatory requirements, or supply chain variations. Such differences shall not constitute a defect or misrepresentation provided the product supplied is genuine, approved by the relevant regulatory authority, and therapeutically equivalent to the product described.

In compliance with regulatory requirements, Pharmily may:

10. Pricing Accuracy, Errors, Market Fluctuations, Payments and Promotions

In the event of a pricing error or discrepancy, Pharmily reserves the right to correct the price, cancel the affected order prior to dispatch, or contact the customer to confirm whether they wish to proceed at the corrected price or receive a refund.

10.1 Pricing

All prices are displayed in Kenyan Shillings (KES) and include applicable taxes unless stated otherwise.

10.2 Payment Methods

We accept mobile money payments via PayBill 918045 (use your order number as the account number) or cash on delivery.

10.3 Promotions and Discounts

Promotional offers are subject to availability and may be modified or withdrawn without notice in cases of pricing errors, system issues, or misuse.

11. Delivery, Shipping, Storage and Disposal Responsibility

We offer nationwide delivery across Kenya. Estimated delivery timelines are provided at checkout and may vary due to location or unforeseen circumstances.

11.1 Storage and Cold Chain Disclaimer

Once an order has been delivered, responsibility for proper storage and handling transfers to the customer. Pharmily is not liable for product deterioration resulting from improper storage, temperature exposure, or mishandling after delivery especially for biologics, insulin, beauty products and other injectables. Ensure you strictly follow storage instructions for all products.

11.2 Medication Disposal Disclaimer

Customers are responsible for safe disposal of unused or expired medications in accordance with applicable guidelines and are encouraged to return such products to licensed disposal points.

11.3 Third-Party Courier Disclaimer

Where delivery is performed by third-party courier services, Pharmily shall not be liable for delays, losses, or damages caused by such third parties beyond its reasonable control, provided reasonable care was taken in dispatching the order.

12. Drug Availability and Partial Fulfilment

Due to supply chain constraints, certain products may become unavailable after an order is placed. Pharmily reserves the right to partially fulfil orders and refund unavailable items or offer suitable alternatives with customer consent.

13. Returns and Refunds

Due to the sensitive nature of medicines and health products, returns are limited. Only defective or damaged items may qualify for return.

All return or refund requests must be submitted within 7 days of delivery and are subject to inspection and approval.

14. Jurisdiction Limitation, Cross-border Use and Resale Prohibition

All products supplied by Pharmily are intended for personal use within Kenya only. Exporting, reselling, redistributing, or supplying products outside Kenya is strictly prohibited.

Users accessing the Site from outside Kenya do so at their own risk and are responsible for compliance with local laws.

Data obtained through third-party login services is used solely for account authentication, service delivery, and customer support in accordance with Pharmily’s Privacy Policy.

15.2 Third-Party Services and Integrations

Pharmily may engage third-party service providers for analytics, payment processing, delivery, customer support, and system operations. Pharmily shall not be liable for failures, interruptions, or breaches attributable to such third parties beyond its reasonable control.

15.3 Advertising

Any third-party advertisements or promotional content displayed on the Site do not constitute endorsement by Pharmily.

15.4 Third-Party Brands and Manufacturer Responsibility

Pharmily acts as a distributor/retailer of third-party products. Product performance, warranties, and guarantees remain the responsibility of the manufacturer, unless expressly stated otherwise.

All medication dispensing decisions are made by licensed pharmacists in accordance with applicable laws and professional standards. Automated outputs are subject to professional review and verification.

Pharmily shall not be liable for any outcomes arising from reliance on automated systems without pharmacist confirmation or from user interpretation of system-generated information.

18. Limitation of Liability and Dispute Scope

To the fullest extent permitted by law, Pharmily shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.

18.1 Class-Action Deterrence

Disputes shall be resolved on an individual basis and not as part of any collective or representative action.

19. Indemnification
